1. General information

This policy applies to the www Service operating at the URL: Nekuda.eu.
The operator of the Service and the controller of personal data is: BIMEDIS LTD., 71-75 Shelton St, Covent Garden, London WC2H 9JQ, United Kingdom.

The Operator is the Controller of your personal data with regard to data provided voluntarily in the Service.

The Service uses personal data for the following purposes:
Handling enquiries via the form.

The Service performs functions of obtaining information about users and their behaviour in the following ways:
Through data voluntarily entered in forms, which are then entered into the Operator’s systems.
Through saving cookie files on end devices (so-called “cookies”).

3. Hosting

The Service is hosted (technically maintained) on the hosting provider’s server: cyberFolks.pl.
In order to ensure technical reliability, the hosting company keeps logs at the server level. The following may be recorded:
resources identified by a URL identifier (addresses of requested resources – pages, files),
time of arrival of the request,
time of sending the response,
client station name – identification carried out by the HTTP protocol,
information about errors that occurred when carrying out the HTTP transaction,
the URL address of the page previously visited by the user (referrer link) – if the transition to the Service occurred via a link,
information about the user’s browser,
information about the IP address,
diagnostic information related to the process of self-ordering services via registrars on the website,
information related to handling email addressed to the Operator and sent by the Operator.

4. Your rights and additional information about how data is used

Your personal data is processed by the Controller no longer than is necessary to perform activities related to it, specified by separate regulations (e.g. relating to keeping accounts). With regard to marketing data, the data will not be processed for longer than 3 years.

You have the right to request from the Controller:
access to your personal data,
rectification,
erasure,
restriction of processing,
and data portability.

You have the right to object, with respect to the processing indicated in point 3.3(c), to the processing of personal data for the purposes of the legitimate interests pursued by the Controller, including profiling, whereby the right to object cannot be exercised if there are compelling legitimate grounds for the processing overriding your interests, rights and freedoms, in particular the establishment, exercise or defence of legal claims.

You have the right to lodge a complaint about the Controller’s actions with the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych), ul. Stawki 2, 00-193 Warsaw, Poland.

Providing personal data is voluntary, but necessary for the operation of the Service.

In relation to you, activities involving automated decision-making may be undertaken, including profiling, for the purpose of providing services under the concluded agreement and for the purpose of the Controller’s direct marketing.

Personal data is transferred from third countries within the meaning of data protection regulations. This means that we send it outside the European Union.

5. Information in forms

The Service collects information provided voluntarily by the user, including personal data, if such data is provided.
The Service may save information about connection parameters (time indication, IP address).
In some cases, the Service may save information facilitating linking the data in the form with the email address of the user filling in the form. In such a case, the user’s email address appears within the URL address of the page containing the form.
Data provided in the form is processed for the purpose resulting from the function of the particular form, e.g. in order to carry out the process of handling a service request or commercial contact, registration of services, etc. Each time, the context and description of the form clearly informs what it is used for.

Information about users’ behaviour in the Service may be logged. This data is used for administering the Service.

7. Important marketing techniques

The Operator uses statistical analysis of website traffic via Google Analytics (Google Inc. based in the USA). The Operator does not transfer personal data to the operator of this service, only anonymised information. The service is based on the use of cookies on the user’s end device. With regard to information about user preferences collected by Google’s advertising network, the user may view and edit information resulting from cookies using the tool: https://www.google.com/ads/preferences/

8. Information about cookies

The Service uses cookies.
Cookies (so-called “cookies”) are IT data, in particular text files, which are stored on the end device of the Service User and are intended for use of the Service’s websites. Cookies usually contain the name of the website from which they originate, the time of storage on the end device and a unique number.

The entity placing cookies on the end device of the Service User and obtaining access to them is the Service operator.

Cookies are used for the following purposes:
maintaining the Service user session (after logging in), thanks to which the user does not have to re-enter the login and password on each subpage of the Service;
performing the purposes specified above in the “Important marketing techniques” section.

Within the Service, two basic types of cookies are used: “session” cookies and “persistent” cookies. “Session” cookies are temporary files that are stored on the User’s end device until logging out, leaving the website or switching off the software (internet browser). “Persistent” cookies are stored on the User’s end device for the time specified in the cookie file parameters or until they are deleted by the User.

Website browsing software (internet browser) usually allows cookies to be stored on the User’s end device by default. Service Users may change settings in this respect. Cookies placed on the end device of the Service User may also be used by entities cooperating with the Service operator, in particular this applies to companies: Google (Google Inc. based in the USA), Facebook (Facebook Inc. based in the USA), Twitter (Twitter Inc. based in the USA).

If the user does not want to receive cookies, they may change browser settings. We stipulate that disabling cookies necessary for authentication processes, security, and maintaining user preferences may make it difficult, and in extreme cases may make it impossible, to use the websites.
